Terms and Conditions of Use

Welcome to Lobby (the “App”, “Service”, or “Lobby”). These Terms and Conditions of Use (these “Terms”) form a binding agreement between you (“you” or “User”) and [COMPANY LEGAL NAME], a company registered in Hungary under company registration number [COMPANY REG. NO.], with its registered office at [REGISTERED ADDRESS], Hungary (referred to as “we”, “us”, “our”, or the “Company”).

Lobby is a social discovery application that helps adults meet new people in real life by creating and joining small group events, exchanging messages, building a profile, sending friend requests, and endorsing the people they have actually met. By creating an account, accessing, downloading, or using Lobby in any way, you confirm that you have read, understood, and accepted these Terms, our Community Guidelines, and our Privacy Policy. If you do not agree, you must not use the App.

Please pay particular attention to the sections on Eligibility (Section 3), Photo and Face Verification (Section 6), User Conduct (Section 9), Limitation of Liability (Section 17), and Governing Law and Dispute Resolution (Section 22). These sections materially affect your legal rights.

1. About Lobby

Lobby is operated by the Company and made available through the Apple App Store and Google Play. The App is built on Flutter and uses Firebase (operated by Google Cloud) hosted in a European region for authentication, profile data, chat data, event data, push notifications, and crash diagnostics. Photo uploads and biometric face matching are processed by Amazon Web Services (“AWS”). More information about how we process personal data, including where it is stored, is set out in our Privacy Policy.

Lobby is a platform that introduces people to one another. We do not arrange dates, plan the meetings that Users organise, supervise the conduct of Users in person, or otherwise act in any capacity other than as a technology provider. You are solely responsible for your interactions with other Users, both on and off the App.

2. Definitions

Account means the personal account you create in order to use Lobby, identified by a unique user ID assigned by Firebase Authentication.

Event (or Room) means a meet-up created by a User through the App, including its title, description, date, location, place name, capacity, hero image, and chat room.

Member Content means any content that you or another User submits, uploads, posts, transmits, or otherwise makes available through the App, including profile photos, profile text, prompt answers, chat messages, images, locations, date proposals, event details, and reports.

Endorsement means a recommendation given by a User to another User they have met at the same Event, as further described in Section 12.

Face Verification means the biometric process described in Section 6 in which a selfie is compared to your profile photo through AWS in order to confirm that you are the same person as the one shown in your profile photo.

Photo Moderation means the automated and human-assisted process by which the Company reviews profile photos and event images for compliance with these Terms and our Community Guidelines.

3. Eligibility

Lobby is intended exclusively for adults. By creating an Account you represent and warrant that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into a binding agreement under the laws of the country in which you reside;
  • you are not legally prohibited from using the App, including any sanctions, court order, or applicable law;
  • you have not been previously banned, suspended, or removed from the App by us; and
  • you will use the App only for personal, non-commercial purposes.

If we have reasonable grounds to believe that you are under 18, or that you do not meet one of the eligibility criteria above, we may suspend or permanently terminate your Account and remove your Member Content without notice.

4. Your Account and Authentication

To use Lobby, you must create an Account through Firebase Authentication using one of the supported sign-in methods (including, where available, Sign in with Apple). You are responsible for maintaining the confidentiality of any credentials associated with your Account and for all activity that occurs through your Account.

You agree to provide accurate, current, and complete information when creating your Account and to keep that information up to date. You may not create more than one Account, impersonate another person, or use the Account of another User. You must notify us promptly at legal@lobbyapp.eu if you suspect any unauthorised use of your Account.

Sign-in flows operated by third parties (such as Apple) are governed by their respective terms. We are not responsible for the availability or accuracy of those third-party services.

5. Profile Creation and Member Content

As part of onboarding, you may be asked to provide personal information including your first name, age and date of birth, gender, city and approximate location, photo(s), a short biography, interests, education, workplace, drinking and smoking habits, spoken languages, favourite places, and answers to prompts. You decide what to share, but certain fields (such as an approved profile photo) are required in order to complete onboarding and use core features.

You retain all rights you may have in your Member Content. By making Member Content available through the App, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, transmit, display, reproduce, modify (for the limited purpose of formatting, resizing, cropping, transcoding, and applying moderation), and otherwise use that Member Content to operate, improve, and promote the App. This licence terminates within a commercially reasonable period after you delete the Member Content or your Account, except to the extent we are required to retain copies for legal compliance, fraud prevention, safety investigations, or backup purposes, and except for cached or archived copies that may persist on Firebase, AWS, or third-party app stores beyond our control.

You represent and warrant that you have all rights necessary to grant the licence above, that your Member Content does not infringe any third party’s rights (including intellectual property, privacy, or publicity rights), and that your Member Content complies with these Terms and the Community Guidelines.

Your main profile photo (the first photo on your profile) is subject to stricter rules than your other photos. Once it has been approved by our content moderation system and matched to you through face verification, you cannot unilaterally delete it. The only way to change it is the gated replacement flow described in Section 6.2: upload a new photo, have that new photo pass content moderation, then complete a fresh face verification against the new photo. If you exit the flow at any point before face verification succeeds, no change is committed and your previous main photo and verified status are automatically restored. The position of your cover photo is also fixed and cannot be changed by drag-reordering.

6. Photo Moderation and Face Verification

6.1 Profile photo moderation

All profile photos you submit are uploaded directly to AWS via a signed URL provided by our backend. Photos are screened automatically for safety and quality. Until a photo is marked as approved, it cannot be used as your active profile photo. Photos that are rejected by automated moderation may be retried, replaced, or, where appropriate, reviewed by our team. Onboarding can only be completed with at least one approved profile photo.

6.2 Face verification (biometric processing)

To help confirm that people on Lobby are who they say they are, we operate a face verification feature. Face verification is performed in two situations: (i) when you complete onboarding, and (ii) every time you replace your main profile photo (see Section 5). Face verification works by asking you to take a live selfie inside the App. The selfie is transmitted to AWS and compared against your current approved main profile photo using AWS Rekognition or a comparable face-comparison service. Selfie bytes are processed in memory only and are not written to any AWS persistent storage; only metadata (similarity score, verification status, reason code, and timestamps) is retained. If the similarity score is sufficient, your profile is marked as “face verified” against the active photo. If not, you may be asked to retry, or your verification may be rejected. For a main-photo replacement, if you exit or the verification fails, no change is committed and your previous photo and verified status are automatically restored.

Face data processed during verification is biometric data within the meaning of Article 9 of the EU General Data Protection Regulation. We process this data only with your explicit consent, which you give when you start the verification flow. You may withdraw that consent at any time by deleting your verification status from the App. We retain selfies and similarity scores only for the period strictly necessary to perform verification, prevent abuse, and defend legal claims, as further described in our Privacy Policy.

Verification attempts are rate-limited (currently no more than 5 attempts per hour and 10 per day per User) to prevent abuse. Submitting another person’s photo, a photo of a printed image, a deepfake, or otherwise attempting to defeat verification is a material breach of these Terms and may result in immediate suspension of your Account.

Face verification is provided “as is”. A verified badge indicates only that automated face comparison succeeded; it is not a background check, identity check, or guarantee that another User is safe, honest, or who they appear to be. You must continue to exercise your own judgement when interacting with other Users.

7. Events and Rooms

7.1 Creating an Event

Any eligible User may create an Event. When you create an Event, you must provide accurate information including a clear title and description, a real future date and time, a real location and place name, a category (vibe), and a realistic maximum number of participants. You may add a hero image from our library or from your own content. The location of your Event is converted into a geohash so that other Users near you can discover it. You are solely responsible for the legality, safety, and accuracy of the Event you create.

7.2 Joining an Event

Other Users can request to join your Event, and you can request to join theirs. As the host, you decide whether to accept or decline a join request, invite specific Users, or remove (kick) a participant who breaches the Event’s expectations or these Terms. Joining or being invited to an Event does not create any contractual relationship between Users or between Users and the Company beyond what is stated in these Terms.

7.3 Cancellation, capacity, and conduct

Hosts may cancel an Event before it starts; cancellation does not delete the Event from the system but marks it as cancelled. Participants are expected to behave respectfully toward each other before, during, and after an Event. Conduct that is illegal, harmful, threatening, harassing, discriminatory, sexually exploitative, or otherwise contrary to our Community Guidelines is grounds for removal from the Event, suspension, or permanent termination of your Account.

7.4 No supervision

We do not attend, monitor, or supervise Events. Meeting another User in person carries real-world risk. You agree that you meet other Users at your own risk, and that the Company is not responsible for any loss, injury, damage, or harm arising out of any in-person interaction. You should always meet in public places, tell a trusted person where you are going, and stop the interaction if anything feels unsafe.

8. Chat and Messaging

Each Event has an associated chat room available to its participants. Messages may include text, images, locations, date proposals, and system messages generated by the App. Messages are stored on Firebase in our European region and are visible to the participants of the Event. You must not use chat to send messages that violate these Terms, our Community Guidelines, or applicable law.

We may, but are not obliged to, review chat content to investigate reports, enforce these Terms, prevent harm, or comply with legal obligations. Where we are legally required to do so, we may disclose chat content to law enforcement or regulatory authorities.

Chat is designed for in-Event coordination, not as a long-term archive of your conversations. Messages in an Event chat are automatically and permanently deleted approximately 35 days after the Event’s scheduled date — specifically, 30 days after the Event is treated as “closed”, where an Event is treated as closed 5 days after its scheduled date. If an Event is rescheduled, the deletion window shifts with the new date. Once deleted, messages cannot be recovered, by you or by us. You should not rely on the chat as a record of conversations; if you need to keep a particular message, save a copy on your device before the window elapses. Chat content is transmitted over TLS and encrypted at rest by Google Cloud (AES-256, keys managed by Google), but it is not end-to-end encrypted, which means it is technically accessible to us while it exists, to the extent permitted by these Terms and applicable law (for example, to investigate reports or to comply with legal obligations).

9. Acceptable Use and Community Guidelines

When you use Lobby, you agree that you will not, and will not attempt to:

  • upload, share, or transmit content that is illegal, defamatory, obscene, sexually explicit involving minors, hateful, harassing, threatening, violent, fraudulent, deceptive, or otherwise inappropriate;
  • misrepresent your identity, age, location, or affiliation, including by creating profiles for fictional people, businesses, brands, or pets;
  • use another person’s photo or likeness without their consent;
  • use Lobby for solicitation, prostitution, escort services, multi-level marketing, recruiting, fundraising, political campaigning, or any other commercial purpose;
  • collect, scrape, or harvest information about other Users, including their photos, profile data, location, or messages, by any automated or manual means;
  • circumvent, disable, or interfere with security-related features of the App, including photo moderation, face verification, rate limits, content filters, or reporting mechanisms;
  • upload malware or content that exploits, attacks, or otherwise compromises the App, our infrastructure, or any User;
  • reverse engineer, decompile, or disassemble any part of the App, except to the extent expressly permitted by mandatory law;
  • use the App in any jurisdiction in which doing so is unlawful, or in a way that violates applicable export controls or sanctions;
  • contact a User who has unmatched, blocked, or removed you, or attempt to do so through alternative channels.

We reserve the right (but not the obligation) to investigate, remove, or restrict any Member Content, suspend or terminate any Account, and take any other action we consider appropriate to enforce these Terms and protect our Users.

10. Reporting, Moderation, and Safety

The App provides in-product tools to report a User, an Event, or a specific piece of content. When you submit a report, you provide a category and, optionally, a written description. We use reports, automated signals (including AWS-based image moderation), and human review to enforce these Terms.

We may remove or restrict content, hide Events, suspend Accounts, revoke verified status, or permanently ban Users based on the outcome of such review. We may also share information with law enforcement where required by law, where we believe in good faith that disclosure is necessary to prevent imminent harm, or where we are responding to a valid legal request.

If you encounter content that you believe constitutes a serious threat to a person’s safety, you should also contact your local emergency services. Lobby is not an emergency service and cannot guarantee a response within any particular timeframe.

11. Friend Requests and Connections

Lobby includes a friendship feature that allows you to send a friend request to another User and, with their acceptance, become connected within the App. You can also be invited to Events by your friends. A friend request can be cancelled, declined, or revoked at any time, and you can remove a friend or block a User from your friends list. We do not guarantee that any User will accept a friend request from you, and we may rate-limit or otherwise restrict the friend system to prevent spam or abuse.

12. Endorsement (Rating) System

Lobby uses a positive-only endorsement system, similar in spirit to a professional network recommendation. After an Event, participants may endorse other participants of the same Event. Endorsements are recorded as the presence of a recommendation; the absence of an endorsement carries no penalty, no negative score, and is not displayed as a negative signal. Counts of endorsements you have received are aggregated server-side and shown on your profile.

You agree to use the endorsement system honestly and only in respect of Users you have actually met at the Event. We may remove endorsements that are obtained through abuse, collusion, or that otherwise breach these Terms.

13. Push Notifications and Location

Lobby uses push notifications through Firebase Cloud Messaging to inform you about chat messages, join requests, event updates, friend activity, and safety notices. You can disable push notifications at any time in your device settings; some notifications are essential to using the App and disabling them may degrade your experience.

Certain features (such as event discovery, distance filtering, and recommended Events) use your approximate location, derived from the city you select and, where you grant the permission, from your device. You may revoke location permission at any time in your device settings, in which case discovery features may be limited or unavailable.

14. Third-Party Services and App Stores

Lobby is delivered through, and relies on, services provided by third parties, including Apple, Google, Firebase (Google Cloud), and AWS. Your use of those services is also governed by the terms of those third parties. We are not responsible for, and do not endorse, the content, policies, or practices of any third-party service, except as expressly stated in these Terms or our Privacy Policy.

If you accessed or downloaded Lobby through the Apple App Store, you acknowledge that these Terms are between you and the Company only, not with Apple, and that Apple is not responsible for the App or its content. The same applies to Google Play.

15. Paid Features (If and When Offered)

At the date these Terms come into force, Lobby is provided to Users free of charge. We reserve the right to introduce optional paid features, subscriptions, or in-app purchases in the future. If we do, the following will apply:

  • paid features will be offered through the Apple App Store or Google Play, and the relevant store’s billing, refund, and cancellation rules will apply;
  • we will clearly indicate the price, billing cycle, and renewal terms before you confirm any purchase, and we will obtain your express consent before charging you;
  • subscriptions will renew automatically at the end of each billing cycle until you cancel through your store account;
  • EU and EEA consumers will retain their statutory rights, including (where applicable) the right of withdrawal within 14 days from the conclusion of a paid contract, except where you have expressly requested immediate performance and acknowledged that you lose your right of withdrawal once performance has begun;
  • we may publish updated commercial terms in-App or as an addendum to these Terms before any paid feature becomes available.

16. Disclaimer of Warranties

To the maximum extent permitted by law, the App, the Service, and all Member Content are provided to you on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or quiet enjoyment. We do not warrant that the App will be uninterrupted, error-free, free of viruses or other harmful components, or that defects will be corrected.

We make no representation or warranty as to the identity, conduct, character, or compatibility of any User. We do not perform criminal background checks. Verified status, where granted, only confirms that a face comparison was successful and does not constitute an identity or background check.

Some jurisdictions do not allow the exclusion of certain warranties. To the extent any such warranty cannot be excluded, our liability is limited to the minimum extent permitted by applicable law.

17. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will the Company, its affiliates, directors, officers, employees, contractors, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of goodwill, business interruption, or personal injury, arising out of or related to your use of, or inability to use, the App or any interaction with another User, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, the Company’s aggregate liability arising out of or related to these Terms or the App will not exceed the greater of (i) the total amount you paid to us, if any, in the twelve months preceding the event giving rise to the claim, and (ii) EUR 100.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited under Hungarian or EU law (including, where applicable, statutory consumer rights).

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless the Company, its affiliates, and its and their respective directors, officers, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees and costs, arising out of or related to: (i) your use or misuse of the App; (ii) your Member Content; (iii) your interactions with other Users, online or offline; or (iv) your breach of these Terms, the Community Guidelines, or any applicable law or third-party right.

19. Term, Suspension, and Account Deletion

These Terms apply from the moment you create an Account or otherwise use the App, and remain in force until terminated.

You may delete your Account at any time through the App’s settings (Settings → Delete account) or by contacting us at legal@lobbyapp.eu. When you delete your Account, we will remove your profile and personal data in accordance with our Privacy Policy, subject to retention periods required by law, fraud prevention, safety investigations, or the resolution of disputes. Certain Member Content (for example, anonymised endorsements, chat messages sent to other Users, or content already shared) may persist after deletion in a form that no longer identifies you.

We may suspend or terminate your Account, with or without notice, if we reasonably believe that you have breached these Terms or the Community Guidelines, if your conduct poses a safety risk, or if we are legally required to do so. Sections relating to Member Content licence, intellectual property, disclaimers, liability, indemnification, governing law, and dispute resolution will survive termination.

20. Intellectual Property

All rights, title, and interest in and to the App, including its source code, design, trademarks, logos, the “Lobby” brand, and any content provided by us (other than Member Content), are owned by the Company or our licensors and are protected by intellectual property laws. Except for the limited licence to use the App granted to you in these Terms, no rights are granted to you by implication, estoppel, or otherwise.

You may not copy, modify, distribute, sell, lease, or create derivative works of any part of the App, except as expressly permitted by these Terms or applicable mandatory law.

21. Privacy and Data Protection

The Company is the data controller for personal data processed through Lobby. We process personal data in accordance with the EU General Data Protection Regulation (Regulation (EU) 2016/679, “GDPR”), Hungarian data protection law, and our Privacy Policy, which forms part of these Terms by reference. The Privacy Policy explains, among other things, what personal data we collect, the legal bases on which we process it, how long we keep it, the third parties involved (including Firebase and AWS), international transfers, and your rights as a data subject.

You have the right to access, rectify, erase, restrict, port, and object to the processing of your personal data, and to lodge a complaint with a supervisory authority, including the Hungarian National Authority for Data Protection and Freedom of Information (Nemzeti Adatvédelmi és Információszabadság Hatóság, NAIH). You can exercise your rights by contacting privacy@lobbyapp.eu.

22. Governing Law and Dispute Resolution

These Terms and any non-contractual obligation arising out of or in connection with them are governed by the laws of Hungary, without prejudice to the mandatory protections available to you as a consumer under the laws of your country of habitual residence within the European Union or European Economic Area.

Subject to your mandatory consumer rights, the courts of Budapest, Hungary, will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the App. Consumers may also bring proceedings before the courts of the EU Member State in which they are domiciled.

The European Commission provides an online dispute resolution platform for consumer disputes, available at https://ec.europa.eu/consumers/odr. You may also contact your local consumer protection authority. We are not obliged to participate in alternative dispute resolution before a consumer arbitration board unless required by law.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in the App, our business, or applicable law. If we make a material change, we will let you know in-App and update the “Last updated” date above. By continuing to use the App after the changes take effect, you accept the updated Terms. If you do not accept the changes, you must stop using the App and may delete your Account.

24. Miscellaneous

24.1 Entire agreement

These Terms, together with the Community Guidelines and the Privacy Policy, constitute the entire agreement between you and the Company concerning the App and supersede any prior or contemporaneous agreements between you and us on that subject.

24.2 Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

24.3 No waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

24.4 Assignment

You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign these Terms to an affiliate or to a successor in connection with a merger, acquisition, restructuring, or sale of assets.

24.5 Force majeure

We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, internet or telecommunications failures, or actions of governmental authorities.

24.6 Language

These Terms are provided in English. Where we make a translation available, the English version will prevail in case of conflict, except where mandatory consumer protection law in your country of residence provides otherwise.
